(RepublicanWire.org) – A federal judge in Florida has ruled on the Biden administration’s “catch and release” program along the border, finding it unlawful.

A federal judge in Florida on Wednesday agreed with the state’s Republican attorney general that the policy of President Joe Biden’s administration to release many people who illegally cross the U.S.-Mexican border rather than detaining them violates U.S. immigration law.

U.S. District Judge T. Kent Wetherell in Pensacola blocked the administration from continuing to implement a 2021 Department of Homeland Security (DHS) memo that had authorized “alternatives to detention” to ease overcrowding in detention facilities. These alternatives included ankle bracelets, phone monitoring or check-ins by immigration officers. Republican critics have called the policy “catch and release.”

Judge Wetherell, who was a Trump appointee, didn’t mince words in his decision, comparing Biden’s policies to a “Come In, We’re Open” sign on the border.

“For the most part, the court finds in favor of Florida because, as detailed below, the evidence establishes that defendants have effectively turned the Southwest border into a meaningless line in the sand and little more than a speedbump for aliens flooding into the country,” wrote Wetherell…

Wetherell added that the Biden immigration policies were “akin to posting a flashing ‘Come In, We’re Open’ sign on the southern border. The unprecedented ‘surge’ of aliens that started arriving at the Southwest Border almost immediately after President Biden took office and that has continued unabated over the past two years was a predictable consequence of these actions.”

The lawsuit challenging the police was filed by Florida in 2021. The state argued DHS was violating a specific law by releasing thousands of migrants and forcing the state to spend significant amounts of money to care for them.

The complaint says the U.S. Department of Homeland Security is violating the Immigration and Nationality Act by abusing its authority to temporarily parole individuals who otherwise must be detained pending deportation proceedings.

The statute allows Homeland Security to use its parole powers only on a case-by-case basis and for “urgent humanitarian reasons or significant public benefit.”

President Joe Biden in February withdrew a 2018 executive order by former President Donald Trump that eliminated the “catch and release” policy…

Moody’s office said the catch and release policy is costing Florida millions. The state prison system spends more than $100 million per year incarcerating individuals who are unlawfully present in the U.S. and about $8,000 per student for public school education, which is provided regardless of immigration status, the AG said.

Judge Wetherell gave the Biden administration seven days to appeal before his decision takes effect. It’s not clear what would actually happen if this takes effect. How long would the Biden administration need to hold migrants applying for asylum before releasing them. At present the backlog to see a judge is more than a million cases. So the average time for adjudication of an asylum claim is up to around seven years. The administration can’t possibly detain all of the people who arrive to claim asylum. More likely a judge would determine that people awaiting their day in court could be released but this would presumably be done on a case by case basis rather than as a blanket policy.

Even some amount of detention might weed out the economic migrants claiming asylum as a gimmick to get a free pass into America. As the Judge suggested, by making it easy to game the system, we’ve put a flashing sign up on the border.

(RepublicanWire.org) – Secretary of Homeland Security Alejandro Mayorkas dodged questions about “gotaways” from MSNBC host Jose Diaz-Balart Tuesday during an interview about the border.

“Some of the criticism includes, for example, the 600,000-plus get-aways, folks who came into this country and didn’t go through the process of requesting asylum. So, do you know where they are and who they are, the people that don’t request asylum when they arrive here?” Diaz-Balart asked Mayorkas.

“For the first time since 2011, the president of the United States presented a budget successfully that increased the number of Border Patrol agents,” Mayorkas said. “For the first time, this year we have 300 more Border Patrol agent eligibility positions than we did in the past. We are making tremendous strides. We are devoting tremendous resources to enhance border security and we’ll keep at it.”

Diaz-Balart again questioned Mayorkas about the “gotaways,” people who evaded CBP at the border.

“Do you know where they are and who they are?” the MSNBC host asked.

“So, gotaways have been a challenge from year to year, regardless of the administration, whether it’s more than a million in the early part of this department’s administration or it’s hundreds of thousands over the ensuing years,” Mayorkas said. “But what we are doing is dedicating people, physical assets, and an increasing reliance in use of innovative technology to enhance our visibility and our interdiction capabilities.”

U.S. Customs and Border Patrol (CBP) encountered over 2.3 million migrants in Fiscal Year 2022, while another 600,000 migrants evaded CBP that fiscal year, Fox News reported. CBP reported encountering 230,000 people in October, the first month of fiscal year 2023, another 233,470 people in November, the second month of fiscal year 2023 and over 250,000 in December.

Republican Rep. Pat Fallon of Texas introduced a resolution to impeach Mayorkas Jan. 3, while the House Judiciary Committee scheduled a hearing on the border for Feb. 6.

(RepublicanWire.org) – President Joe Biden was resoundingly criticized for equating illegal border crossers at U.S. border to Jews escaping Nazi Germany.

When a reporter asked if he believes migration is a human right, the president Thursday was quick to compare the situation at the border to the Holocaust. 

“Well, I think it is a human right if your family is being persecuted,” Biden responded. “I thought it was a human right for, you know, Jews in Germany to be able to go — to get to escape and get help where they could.”

Americans on Twitter noted illegal migrants are not innocent victims like “Jews in Germany” during World War II and the Holocaust.

“Biden just compared illegal aliens — lawbreakers who have been found to be terrorists, drug dealers, and bad actors — to Jews fleeing Germany during the Holocaust,” Rep. Andy Biggs, R-Ariz., tweeted Thursday. “Not even remotely the same situation.

“This kind of mindset prevents us from legitimately securing our border.”

Rep. Claudia Tenney, R-N.Y., tweeted Thursday that Biden’s “shameful” remark was “out of touch.”

“Border patrol has apprehended terrorists, cartels, drug smugglers, and human traffickers at the border,” Tenney wrote. “Biden’s disgusting comparison between his illegal immigration surge and Jews fleeing Nazi Germany is shameful and out of touch.”

Conservative lawyer Mark Levin’s Twitter account also issued a rebuke Friday.

“What a disgusting and awful statement from this ignoramus, and the corrupt media are silent,” the tweet read.

Former Trump administration staffer Stephen Miller was once classified by the liberal media as a “white nationalist,” according to CNN, but he too noted the bad look of Biden’s Holocaust comparison.

“Comparing Haitians leaving Haiti or Nicaraguans leaving Nicaragua to Jews fleeing violent extermination from Nazi Germany is both an outrageous minimization of the Holocaust and a vile slander of Latin American nations,” former Trump administration staffer Stephen Miller tweeted Thursday.

“Biden will say or do anything to expand illegal immigration.”

Joel M. Petlin tweeted, “There are many comparisons the President can make to illustrate the need to help solve the southern border crisis.”

“The comparison with Jews fleeing deportation to Nazi death camps is not an appropriate one.”

” With all the misinformation, we don’t need Holocaust minimization now.”

(RepublicanWire.org) – A number of White House reporters pressed White House press secretary Karine Jean-Pierre about the border crisis in the days before a Trump-era immigration policy was expected to be terminated.

One of the reporters asked about Vice President Kamala Harris’ role in combating the border crisis, given she had been appointed to address the “root causes” of migration with the Northern Triangle countries: Guatemala, Honduras and El Salvador.

“I’m wondering if there’s any update .. on what [Kamala Harris] has been doing and what she will continue to do” about the border,” a reporter asked Karine Jean-Pierre.

“I don’t have anything to lay out specifically on what that work looks like … I would probably refer you to her office,” Karine Jean-Pierre said.

Harris has insisted in recent months that “the border is secure.” The vice president traveled to the border once, six months into her term, but has not been back since then. She has spent three days in Latin America on two separate trips in her role.

A tracker of Harris’ scheduled events and meetings from the Los Angeles Times shows the last public appearance she made in which she discussed immigration was on June 15. The database shows 20 scheduled events for Harris on immigration in her nearly two years as vice president but only three since Aug. 5, 2021.

Officials in the administration, including Harris, have repeatedly said the border is “secure,” despite U.S. Customs and Border Protection logging roughly 2.3 million migrant encounters in fiscal year (FY) 2022. Encounters have peaked to record-high numbers in FY 2023, which began in October 2021.

A surge of migrants has arrived at the southern border in recent days as Wednesday marks the expiration of the so-called Title 42 policy, a pandemic-era policy under President Donald Trump that called on border agents to turn away migrants at the border as a way of coping with the pandemic. Jean-Pierre insisted last Wednesday that the end of the Title 42 policy does not mean the border is open.

(RepublicanWire.org) – During a Senate hearing on Thursday, Homeland Security Secretary Alejandro Mayorkas appeared to change his tune when it comes to the southern border after saying earlier in the week that it is secure.

The secretary’s responses on Thursday were a change from what he told a House committee on Tuesday. When asked by Rep. Dan Bishop, R-N.C., if the southern border is secure, Mayorkas said, “Yes, and we are working day in and day out to enhance security, congressman.”

Mayorkas the same series of questions the head of Border Patrol was asked by Florida officials earlier in the year, the first of which being whether the southern border is in a state of crisis.

“The entire hemisphere is suffering a migration crisis,” Mayorkas said. “We are seeing an unprecedented movement of people from country to country. It is not restricted to the southern border.”

The secretary cited “unprecedented” movement of people out of Venezuela, with many currently situated in Colombia.

Portman, not interested in Colombia or Venezuela for the purposes of the meeting, repeated his question about whether there is a crisis at the border.

“We are seeing a significant challenge at the southern border, as we are seeing it throughout the hemisphere,” Mayorkas said.

Portman’s next question was about whether there is an unprecedented number of migrants crossing the border, and Mayorkas confirmed that this past year it has been “the highest on record.”

Later in the hearing, Sen. James Lankford, R-Okla., challenged Mayorkas to provide some information about what the Biden administration plans to do about an expected increase of migrants crossing the border when the Title 42 public health order is no longer in place to allow swift deportation of illegal immigrants from countries affected by COVID-19.

“Secretary Mayorkas, you and I have talked about Title 42 for about 18 months, and I’ve asked you the question, what happens when Title 42 goes away, and for 18 months you’ve said we’re working on it,” Lankford said. The Republican then pointed to the recent court order calling for Title 42 to be lifted, after the Biden administration had previously failed to lift it on its own.

“But we’re still waiting to try to figure out what happens now and how many are about to cross the border,” Lankford continued. “What’s the plan for dealing with this massive migration, illegal immigration coming now post Title 42?”

Mayorkas responded by saying the administration’s plan remains the same as it was in April, and that they “have indeed been executing on the plan.” The secretary then briefly outlined a six-pronged approach that includes a surge of resources — personnel, technology, transportation and more — to the border; increasing the processing efficiency of Customs and Border Protection; increasing the consequences for entering the country illegally; strengthening nonprofit organizations and police at the local and state levels; targeting smuggling operations; and working with other countries to the south “to deter irregular migration.”

Retired ICE director, Tom Homan, joined Brian Kilmeade on “Fox &Friends” earlier in the week, and revealed what is really happening at the border.

(RepublicanWire.org) – GOP gubernatorial candidate in Arizona Kari Lake went on CBS’ Face the Nation to tell President Joe Biden time is up and he has failed at the border. She said she will form a compact with other states to enforce the border laws if Biden will not.

Major Garrett started by saying, “your website is detailed and specific on the question of immigration and border security. You call, if elected as governor, for Arizona to join other states to form what you call a compact to carry out border security separate from the federal government, including arrest and detention. For the benefit of Arizona voters, can you explain the legal and practical application of this approach?”

Lake expalined, “well, of course, if you know the Constitution, you know that Article 4, Section 4 calls for the federal government to protect us from invasion, and under Joe Biden’s lack of leadership, we just aren’t seeing that. And we have an invasion at our border, the cartels, these Narco terrorist groups have operational control.

And they’re using Arizona to smuggle people, to traffic children and to traffic the most dangerous drug we’ve ever seen, fentanyl. 

And so we’re going to invoke our Article One, Section 10, basically, authority to take care of our own border and protect our own border. It’s right there in black and white in the Constitution.

And we meet all three criteria, we have an invasion, our people are in imminent danger, and time is of the essence. There’s no time for delay.

So we’re going to have other states offer help. I’ve already got a couple other governors who are willing to help out.

And I know that if you ask people in other states that are not border states, they deem this crisis on the border as one of the top issues facing our country–

Major Garrett asked again, “would Arizona go it alone if it didn’t get this compact agreement with other states?”

Lake answered, “yes, we will. But I believe we will get help. I’ve already talked to some other governors and they’re- they’re vowing to help us out wherever they can, because they realize that what comes into Arizona, fentanyl, people coming here illegally, children being trafficked, doesn’t stay in Arizona, it goes to all 50 states. And I just spoke last week to a mother and father who lost their son. And it’s just tragic. We’re losing more people to fentanyl in Arizona, since Joe Biden took office than we lost in 9/11 or during COVID.”

(RepublicanWire.org) – Republicans have had enough of President Biden and his administration’s inability to secure the border, and are effectively taking the matter into their own hands. That was exactly what the Lieutenant Governor of Texas, Dan Patrick said he was going to do during a Saturday taping of “Fox and Friends”.

Texas Lieutenant Governor Dan Patrick (R-TX) stated, that that state will “keep those buses coming” as long as the southern border remains unsecured.

“I’m serious about this. The legislators are serious about this. The people of Texas are serious about it,” Patrick began. “The other thing I’d want to do, we’re spending, by the way, to put this in perspective to all these whiny babies up in these blue states, ‘Oh, this is such a crisis.’ We normally spend $400 million a year on border security.”

“We’re spending over $4 billion of Texas taxpayer money, money we could spend on health care, on education, on more roads, whatever it might be, $4 billion a year.

We have our National Guard there on the border,” the Texan explained, adding, “This is a financial burden on us. But most importantly, it’s an invasion of our state.”

State and local officials across the Lone Star State have begun to use the language of invasion in an effort to not only call it what it is, but also set the legal foundations for additional action by law enforcement to secure the border, per the Texas Tribune.

Just this past week, two more Texas counties, Wharton and Burnet counties, called for “additional measures to secure the border, stop the invasion at the border, and protect our communities.” They join 27 other Texas counties that have released similar resolutions, according to The Center Square.

Texas itself has spent billions of dollars attempting to fill the void left by the Biden administration via Operation Lone Star which utilized state national guard troops to patrol the Rio Grande.

“I’ve said it for a long time, I’m not shy about the word. But we have to do this the right way.

But I will also propose that since we’re spending so much money, I’d like to hire every Border Patrol agent on the border,” adding, “Every one of them. There’s about 8,000.”

We can afford to do it, hire them and make a new state border guard so that Joe Biden doesn’t have one person left. And by the way, the Border Patrol agents are heroes in my book.

They hate working for this guy. I think they love working for Texas…”

(RepublicanWire.org) – Border Patrol Chief Raul Ortiz said under oath that President Biden’s border policies have “no consequences” for illegal migrants traveling into the U.S. and are to blame for the unprecedented surge at the border and release of hundreds of thousands into the interior of the country.

Ortiz’s assertions, which came during a recorded deposition from July 28 as part of discovery in a lawsuit by Florida Attorney General Ashley Moody against the Department of Homeland Security and other border agencies.

Ortiz, who has more than 31 years of experience in law enforcement, told attorneys representing Florida that he believes migration will increase at an exponential rate at the southern border because there are no “consequences” in place to curb the tide of migrants flooding into the U.S.

“In my experience, we have seen increases when there are no consequences,” said Ortiz during the deposition.

“So, if migrant populations believe that they’re going … there are not going to be consequences, more of them will come to the border. Is that what you’re saying?” questioned the attorney.

Ortiz responded: “There is an assumption that if migrant populations are told that there is a potential that they may be released, that, yes, you can see increases.”

“So, it will increase at an exponential rate. Is that what is being suggested here?” continued the attorney.

“Well, I do think it will increase, yeah,” responded Ortiz.

In addition, the attorney pressed Ortiz, asking, “Since President Biden was elected, does this document indicate that aliens illegally entering the United States perceive that they will be able to enter and remain in the United States?”

“Yes,” he told the lawyers while under oath.

During the deposition, Ortiz went on to testify that the southern border is currently in crisis and replied “yes” when asked if the border is “less safe for Americans and aliens alike.”

Ortiz said he agreed with a statement by the plaintiff attorney that “unprecedented numbers” of migrants have illegally entered the U.S. this year. There have so far been more than 2 million migrant encounters with Border Patrol this fiscal year, already surpassing the historic 1.7 million encountered last fiscal year.

Ortiz’s testimony comes after DHS Secretary Alejandro Mayorkas said during the Aspen Security Forum that although the situation is a “historic challenge,” the border is “secure.”

“The Biden administration caused the surge, made the border less safe and is flagrantly violating the very federal laws they swore to uphold. The Biden administration is putting hard-working border patrol agents in impossible and untenable positions — risking their lives and safety, and I want to thank Chief Ortiz for testifying truthfully at his deposition,” Moody said.

The lawsuit brought by Florida is set for trial in January 2023 in the U.S. District Court for the Northern District of Florida.

Dan Patrick (R) claimed the state’s plan to bus illegal immigrants to liberal cities like New York is not political, and the Lone Star State will keep doing so until the Biden administration makes an effort to address the border crisis, during an interview with Fox News’ “America’s Newsroom” on Monday.

“First of all, this is all voluntary. We’re not forcing anyone to get on the bus. Secondly, that’s part of the agreement. You’re going to the destination. And this is not political, Bill. If it’s political, it’s from the mayor who said he’s going to send door knockers to Texas for the November election to help Democrats. That’s the person who’s made it political.” Patrick explained.

“And by the way, Mayor, don’t threaten Texas. And also, he may spike the Republican turnout so much with that rhetoric — that he’s sending New Yorkers to Texas — that the Republicans might send him an award after we blow them out in November. But that’s the politics of it. They turned it into politics. This is a disaster.”When asked what Texas had to prove, Patrick replied that the Biden Administration needs to address the crisis at the nation’s Southern Border.

“Well, first of all, every mayor of a big blue city, which are most of the top 25 in the country, should be on notice,” he proclaimed. “Look out your window, you might see a bus coming to you one day in the future, and the buses are going to keep coming.” While Patrick admitted he hadn’t heard of any liberal mayors contacting the White House, he still took time to highlight the extent of the problem. “We’ve had now 400,000 people in the Del Rio sector in the last year. The population of that town is 36,000. That’s more than ten times the population,” he added. “It would be like us sending 80 million to New York. We’re desperate, Bill, we gotta make this a story — and no one else is covering it but you Fox News. And so, if we can put pressure on all these Democrat mayors around the country, maybe they’ll pick up the phone and call Joe Biden and say the border is not secure.” America needs to put pressure on the Biden Administration to address this pressing problem, before the future of the country is caught up in this mess.

(RepublicanWire.org) – New York City Mayor Eric Adams threatened to send New Yorkers to Texas to campaign against the state’s Gov. Greg Abbott days after the first busload of migrants arrived in New York City.

According to a Friday press release, Abbott has bussed 6,500 illegal migrants to D.C. and, now, New York City, from the Texas Southern border since the governor announced “Operation Lone Star” in April following the CDC’s announcement that it would end Title 42 restrictions on border crossings.

“We are sending them to the United States Capitol, where the Biden administration will be able to more immediately address the needs of the people that they are allowing to come across our border,” Abbott said when he announced the plan in April.

Abbott sent the first busload of migrants to New York City Friday, saying in a press release that he hoped Adams “follows through on his promise of welcoming all migrants with open arms so that our overrun and overwhelmed border towns can find relief.”

Mayor Adams reacted to the move in a press conference Tuesday.

“I am deeply contemplating taking a busload of New Yorkers to go to Texas and do some good ol’ fashion door knocking,” Adams said, “because we have to — for the good of America, we have to get him Abbott out of office.”

Adams blasted Abbott for sending illegal migrants to his city Monday, calling the move “horrific.”

“And New York is a city that has always represented the Democratic values, the values of our city, showing our compassion, that’s what we’re doing today,” Adams said.

“Because of the Mayor’s poor leadership, high taxes and out of control crime, people are already volunteering to leave New York City without the Mayor asking,” Gov. Abbott’s office stated.

The New York Post asked Eric Adams if he has asked or plans to ask Biden or federal agencies to change the open-border policy and stop the endless flow of illegal border crossers from entering the country. “Shockingly,” Adams said he has no interest in doing so.

Abbott’s spokesman said in a statement, “We hope the Mayor of New York City will come to Texas and campaign for Beto O’ Rourke. He should stop by the Border as well to see the real humanitarian crisis President Biden has created.”
